If counsel is not a member of the Eastern District of California Criminal Justice Act ("CJA") Panel, the Court hereby authorizes the appointee to serve as CJA counsel for Petitioner for the duration of the proceedings in this Court pursuant to Local Rule 180(b)(1). If counsel is not admitted to practice before the Eastern District of California court, pursuant to 18 U.S.C. §§ 3005 and 3006A and this District's CJA Plan, General Order 671, § XV.C.1.g as applied here, the Court hereby authorizes said counsel's Pro Hac Vice admission to practice before this court for the duration of the proceedings, nunc pro tunc to the date the appointing authority first contacted counsel about this appointment. MINUTE ORDER signed by District Judge Edward J Davila on 8/17/2026: As Petitioner was granted voluntary departure by an Immigration Judge, and has not challenged the validity of said grant in the instant petition, the Court GRANTS Respondents' 5 Motion and lifts its no transfer order at Dkt. No. 4 . Respondents contend that Petitioner is detained as a condition of his grant of voluntary departure. Dkt. No. 5 at 2. As stated in 8 C.F.R. § 240.25, "[t]he Service may attach to the granting of voluntary departure any conditions it deems necessary to ensure the alien's timely departure from the United States, including the posting of a bond, continued detention pending departure, and removal under safeguards." Here, the voluntary departure order states that voluntary departure was granted "under any other conditions DHS may direct." Dkt. No. 5-1 at 1. As DHS has directed Petitioner to remain detained until his voluntary departure, and there is no allegation that the voluntary departure was obtained unlawfully, lifting of the no transfer order is warranted. See Luque Fuentes v. Warden, No. 2:26-CV-00663-DJC-AC, 2026 WL 911667, at *1 (E.D. Cal. Apr. 2, 2026) (denying application for a temporary restraining order seeking release where Petitioner had been granted voluntary departure and was still within the departure window).
