ORDER re 1 PETITION for Writ of Habeas Corpus filed by Putharachiyamni Somasundaram. To give the Court time to consider the pending petition, unless otherwise ordered by the Court, the petitioner shall not be moved outside the District of Rhode Island without providing the Court with at least 72 hours advance notice of the move and the reason therefore. TEXT ORDER: Putharachiyamni Somasundaram filed a habeas petition on August 10, 2026, ECF No. 1, and, within minutes, the Court entered an Order, providing that Mr. Somasundaram "shall not be moved outside the District of Rhode Island without providing the Court with at least 72 hours' advance notice of the motive and the reason therefore." ECF No. 3. Mr. Somasundaram's most recent notice to the Court (ECF No. 4) appears to show that this Order was not followed, given that ICE has transferred him to Louisiana. To be clear, court orders are not advisory or mere suggestions; they are binding directives. Failure to comply is a matter the Court is obligated to address. Accordingly, on or before August 14, 2026 at 5 pm, the Government shall file: (1) any and all documents and communications related to the dissemination, receipt, or discussion about this Court's August 10, 2026 Order; (2) the names, agencies, and positions of all individuals involved in, consulted regarding, or informed of the decision to remove Mr. Somasundaram from the District of Rhode Island; and (3) all documents created between the issuance of the Court's August 10, 2026 Order and Mr. Somasundaram's transfer to Louisiana; (4) a statement why the Court should not enforce its Order and require ICE to immediately return Mr. Somasundaram to Rhode Island.
