TEXT ORDER modifying transfer injunction at 2 . The Court has carefully considered Respondents' request that the Court modify its previous Order prohibiting the transfer of Petitioner outside of the Northern District of New York, to permit the transfer of Petitioner to the Western District of New York because there is no federal detention facility in the Northern District of New York, and the closest federal detention facility available to house him is located in the Western District of New York. In addition, Respondents represent that the holding room in Malta where Petitioner was booked is not equipped to hold him. The Court has also carefully considered Petitioners opposition to the modification. In light of the Respondents' representations regarding the availability of housing, the Court MODIFIES its previous Order. Petitioner may be transferred to the Western District of New York but shall not otherwise be moved out of the Northern or Western Districts of New York without leave of the Court. Wherever the Petitioner is housed, Petitioner shall receive timely and appropriate access to counsel both telephonically and/or in person. IT IS SO ORDERED.
