MINUTE ORDER (Text Entry Only) The Court has considered Petitioner's petition (Doc. 1) and motion for temporary restraining order (Doc. 3). This is the second such case filed by Petitioner. In the first action, the Court granted the alternative relief sought and ordered that he be provided a bond hearing. (Case No. 1:26-cv-02303 JLT SKO). He received the bond hearing in May 2026 but was found to be a flight risk--based upon his lack of family ties in the United States and his history if non-compliance with the conditions of his release. (Case No. 1:26-cv-02303 JLT SKO, Doc. 14 at 3-4) Consequently, he was retained in custody. Id. He filed a motion to enforce this Court's judgment, which the Court denied about two months ago, because the IJ had, in fact, complied with the Court's order. Id. He now contends he should be released because he suffers from a mental health condition, which has deteriorated. (Doc. 3-1) He does not assert that he has sought mental health treatment or that mental health treatment requests have been denied or ignored. Id. Though he provides the Court copies of documents related to his arrest/detention in March 2026, he does not provide any medical/mental health records. Thus, though the Court is significantly concerned about Petitioner's mental health, there is no showing that his condition is one that cannot or has not been addressed at his housing facility. Because his petition relies on this same rationale, the fact that he is suffering from mental health challenges, though taken seriously by the Court, does not alone demonstrate that he is likely to succeed on the merits of his petition. Thus, the motion for TRO (Doc. 3) is DENIED.The Court refers the matter to the assigned magistrate judge for a determination on the merits. The Court sets the following briefing schedule, which may be modified by the magistrate judge as needed. Respondents SHALL file their responsive pleading within 21 days. The response SHALL provide the Court with copies of referenced/relevant portions of Petitioner's custody file, including his mental health conditions and treatment sought and received. Petitioner may file a traverse no later than 7 days after the respondents file their brief.In the meantime, unless and until the Court orders otherwise, the Court ORDERS that Respondents shall not remove Petitioner from the United States nor transfer Petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting the court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). Given the exigent circumstances, the Court finds that this order is warranted to maintain the status quo pending the hearing, to preserve the Court's jurisdiction and to preserve Petitioner's access to the Court and any subsequent order and finds that Petitioner has satisfied the factors governing the issuance of such preliminary relief signed by District Judge Jennifer L.
