MINUTE ORDER (Text Entry Only) Petitioner has repeatedly sought a TRO to secure his immediate release in his prior case (Case No.: 1:26-cv-01459 JLT EGC). This Court has repeatedly refused that request. Now, he seeks the same relief in this new case (Doc. 3) His counsel argues at length most of the same issues he's raised in his three prior motions for TRO. Id. Petitioner and his counsel fail to appreciate that part of the orders on his prior motions for TRO, was based on whether the question of Petitioner's detention status should be addressed on shortened time (i.e., as a procedural emergency). Eastern District of California Local Rule 231(b) permits the Court to consider "whether the applicant could have sought relief by motion for preliminary injunction at an earlier date without the necessity for seeking last-minute relief by motion for temporary restraining order." Nothing in the current filing causes the Court to question its prior determinations in the earlier filed case, that the issues raised here--no matter their merit--could have been brought earlier by way of a regularly scheduled motion. The evidence of harm cited by petitioner/counsel is identified by most every petitioner who has sought immigration-related habeas relief from this Court this calendar year--which approaches 6,300 petitions. Petitioner's request is, in effect, an attempt to jump the line ahead of similarly situated individuals. For these reasons, the new request for a temporary restraining order filed in this new action (Doc. 3) is DENIED. Further such requests by counsel for this Petitioner (motions for TROs filed without an adequate showing of emergency) will result in an order to show cause why sanctions should not be imposed. This Court should be spending its time deciding these very important cases, but is instead, spending precious time on yet another unsupported, non-emergency motion for TRO.
