ENDORSED ORDER. Text of Order: Denied. Petitioner Lisa Grennan filed a Petition for a Writ of Habeas Corpus under 28 U.S.C. § 2241 (doc. no. 1) and an Emergency Motion for a Temporary Restraining Order (TRO) (doc. no. 3) asking the court to order United States Immigration and Customs Enforcement (ICE) not to take Petitioner into custody when she appears at the ICE office in Manchester, New Hampshire, on Monday, August 10, 2026 at 10:00 am., pursuant to a verbal directive given to her by an ICE agent on August 5, 2026. A federal district court may entertain a habeas corpus petition only where Petitioner is in custody in violation of the Constitution or laws or treaties of the United States. 28 U.S.C. § 2241(c)(3). To obtain habeas relief, Petitioner must be in custody... at the time [her] petition is filed. Maleng v. Cook, 490 U.S. 488, 490-91 (1989). The custody requirement is jurisdictional. See id. at 490. Where a § 2241 petitioner is seeking protection from future restraint on liberty, such restraint may provide a basis for habeas jurisdiction [only] if it is imminent and inevitable, which is not the case where detention is a matter of executive discretion, even if the odds are great that the expected detention will occur. D.V.D. v. U.S. Dept of Homeland Sec., 821 F. Supp. 3d 102, 138 (D. Mass. 2026) (quoting Gonzalez-Fuentes v. Molina, 607 F.3d 864, 874 n.8 (1st Cir. 2010)). Here, Petitioner is not now in custody, and was not in custody at the time she filed the Petition in this action, and this court, therefore, does not have jurisdiction to consider the Petition. Even if it is likely Petitioner will be taken into custody on Monday August 10, 2026, that possibility does not cure that jurisdictional defect. Accordingly, the Petition (doc. no. 1) is DISMISSED, without prejudice to Petitioners ability to refile a new § 2241 action if she is in fact taken into custody in the future, and the motion for a TRO (doc. no. 3) is DENIED as moot.
