Judge Richard G. Stearns: ELECTRONIC ORDER entered re 8 Response to Petition for Writ of Habeas Corpus - 2241 filed by Antone Moniz. Petitioner Wilson Figueroa Landaverde, a citizen of El Salvador, originally enter the United States without authority in 2015. He was removed on July 15, 2015. He reentered the United States at an undetermined location in 2016, and, on February 24, 2026, U.S. Immigration and Customs Enforcement (ICE) issued him a Warrant of Removal/Deportation. He was arrested in Everett, Massachusetts on the morning of July 1, 2026. He is married to a lawful permanent resident, is the father of two United States citizen children, and owns and operates his own company. He is currently detained in Plymouth County House of Correction. Figueroa Landaverde expressed a fear of returning to El Salvador and asked for an asylum determination. On July 31, 2026, an ICE asylum officer found Figueroa Landaverde to have no reasonable fear of persecution or torture in El Salvador. His request for an Immigration Judge to review the determination is pending.This is Wilson Figueroa Landaverde's second habeas petition for release from his current detention filed in the last six weeks. Like Judge Murphy, the court has no jurisdiction to release Figueroa Landaverde in light of his pending Removal Order unless ICE violates the mandates of Zadvydas v. Davis, 533 U.S. 678 (2001). Here, Figueroa has made no showing that "there is no significant likelihood of removal in the reasonably foreseeable future." Id. at 701. The habeas petition for release from custody is DENIED without prejudice to refiling if/when appropriate. The Clerk may close this case. (MZ) (Entered: 08/18/2026)
