MINUTE ORDER (Text Only Entry) The Court has reviewed the petition (Doc. 1) and motion for temporary restraining (Doc. 2) order filed in this case. The Court observes that it is filed by the same petitioner as in Case No.: 1:25-cv-01367 KES HBK and is filed against the same respondents, though in this case, Secretary Mullin is sued in place of former Secretary Noem. The Court notes also that this new petition is brought by the same law firm as must be obvious to counsel too, in light of the fact that the first 15 pages of the petition are identical to the one filed in the earlier case. Most of the remaining pages of the new petition are the same too, though counsel reformulates at least one argument. Thus, the Court directs the Clerk of Court to re-file this petition (Doc. 1) and the accompanying motion for temporary restraining order (Doc. 2) in Case No.: 1:25-cv-01367 KES HBK, and to recharacterize this new petition as a "First Amended Petition for Writ of Habeas Corpus."
