FINDINGS and RECOMMENDATIONS signed by Magistrate Judge Chi Soo Kim on 09/18/2026 RECOMMENDING that: The 1 Petition for Writ of Habeas Corpus be granted; Respondents' 6 Motion to Dismiss be denied; Respondents be ordered to provide Petitioner Bifang Xu (A# 221-418-672) with a bond hearing before an immigration judge/neutral decisionmaker within 14 days of the adoption of these findings and recommendations where Respondents bear the burden of establishing by clear and convincing evidence that Petitioner poses a danger to the community or a risk of flight to justify her continued detention. Respondents must provide Petitioner and Petitioner's counsel with at least 7 days' notice before the bond hearing. Petitioner shall be allowed to have her counsel present at any such hearing.
