TEXT ORDER: This matter comes before the Court on Petitioner Richard Martin's Verified Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241. D.E. 1 (Petition), asserting he is unlawfully detained by immigration authorities without a bond hearing. Respondents filed a letter response, D.E. 7, acknowledging that Petitioner is entitled to request a bond hearing because he is detained under 8 U.S.C. §1226(a). Therefore, the Court will DISMISS the Petition, D.E. 1, without prejudice as moot. Respondents shall advise the Court in writing, with three days of the outcome of Petitioner's bond hearing. TEXT ORDER: Petitioner has filed a Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241, in which he alleges that he is unlawfully detained under 8 U.S.C. § 1225. D.E. 13 ("Petition"). The parties agree that Petitioner is entitled to a bond hearing because he is detained pursuant to 8 U.S.C. § 1226(a). See D.E. 15 . It is ORDERED that, in accordance with 8 U.S.C. § 1226(a), Respondents shall, within 7 days of this Order, provide Petitioner with an individualized bond hearing before an immigration judge who shall assess whether Petitioner presents a flight risk or a danger to the community pursuant to 8 C.F.R. § 236.1(c)(8), (d)(1). TEXT ORDER: On January 16, 2026, the Court granted Petitioner's Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241, finding he was unlawfully detained without a bond hearing under § 1226(a), and ordered Respondents to provide Petitioner with an individualized bond hearing before an immigration judge within 7 days pursuant to 8 C.F.R. §§ 236.1(c)(8) and 236.1(d)(1) D.E. 16. Petitioner filed a status report on January 25, 2026 seeking immediate release because Respondents failed to comply with the Court order. D.E. 17 . The parties agree that Petitioner is detained pursuant to 8 U.S.C. § 1226(a) and that he is entitled to a bond hearing. See D.E. 15 . Respondents, however, have failed to provide Petitioner with a bond hearing within the time limits ordered by this Court. See D.E. 16. The Court will therefore GRANT the Amended Petition at D.E. 13 . See Lopez Benitez v. Francis, 795 F. Supp. 3d 475, 498 (S.D.N.Y. 2025) (granting release from unlawful detention); Bethancourt Soto v. Soto, No. 25-16200, 2025 WL 2976572, at *9 (D.N.J. Oct. 22, 2025) (same). It is ORDERED that Respondents shall release Petitioner today, by 4:00 PM. Respondents may not redetain Petitioner pursuant to § 1226(a) without first holding a bond hearing. By 6:00 PM today, Respondents shall file a status report regarding Petitioner's release and shall show cause regarding their failure to comply with this Court's order at D.E. 16.
