ORDER. 2 Motion for Leave to Proceed in forma Pauperis is GRANTED and the Court DIRECTS the Clerk to file the Petition. It is hereby: ORDERED that Petitioner IS NOT to be removed or transferred from this District for any reason during the pendency of this action unless and until this Court issues an order to the contrary; and it is further ORDERED that on or before August 17, 2026, Respondents file either (1) a Notice indicating that the factual and legal issues presented in this Petition do not differ in any material fashion from those addressed in Romero v. Crawford. No. 3:25cv788, 2026 WL 94634 (E.D. Va. Jan. 13, 2026), and Ponce Vidal v. Crawford. No. 2:26cv 134, 2026 WL 561188 (E.D. Va. Feb. 27, 2026); or (2) an Opposition to the Petition discussing the material differences between those cases and this Petition; and it is further ORDERED that if Respondents file an Opposition to the Petition, Petitioner shall file any reply in further support of the Petition on or before August 27, 2026. To the extent Petitioner requests this relief in his 3 Emergency Motion for Temporary Restraining Order the motion is GRANTED. Insofar as that motions seeks any further relief, it is DENIED. Respondents are ORDERED to provide Petitioner with a standard § 1226(a) bond hearing before an Immigration Judge on or after September 1, 2026, but n ot later than September 8, 2026. Respondents are further ORDERED to file a status report with this Court within three (3) days of the bond hearing. The Clerk is DIRECTED to enter partial judgment in Petitioner's favor pursuant to Federal Rule of Civil Procedure 58, to forward copies of this Memorandum Order to Petitioner and to counsel for Respondents, and to administratively close this case.
