ORDER. It is ORDERED that Petitioner IS NOT to be removed or transferred from this District for any reason during the pendency of this action unless and until this Court issues an order to the contrary; and it is further ORDERED that on or before August 14, 2026, Respondent file either (1) a Notice indicating that the factual and legal issues presented in this Petition do not differ in any material fashion from those addressed in Romero v. Crawford. No. 3:25cv788, 2026 WL 94634 (E.D. Va. Jan. 13, 2026), and Ponce Vidal v. Crawford, No. 2:26cv134, 2026 WL 561188 (E.D. Va. Feb. 27, 2026); or (2) an Opposition to the Petition discussing the material differences between these cases and this Petition. In either instance, Respondent is INSTRUCTED to address Petitioner's assertions in his Petition and motion for a TRO contending that he is being improperly detained without notice, a warrant, or any valid basis in law. It is furtherORDERED that Petitioner shall file any reply in further support of the Petition and motion for expedited relief on or before August 21, 2026. To the extent that Petitioner's TRO motion seeks ex parte relief in the form of an order directing his immediate release without response from the Government, the 2 Motion is DENIED. To the extent that Petitioner seeks other expedited relief including an order for immediate release, the TRO motion is TAKEN UNDER ADVISEMENT. To the extent the TRO motion seeks an order that Petitioner not be removed from this District during the pendency of this habeas action, the motion is GRANTED as set forth above.
