ORDER. It is therefore ordered that Respondents' Motion (ECF Nos. 7, 8 ) is granted in part and denied in part. Respondents will have up to and including January 6, 2026 to file their response to the Petition (ECF No. 1 -1). It is further ordered that the FPD is appointed to represent Quintana Chagolla. MINUTE ORDER IN CHAMBERS of the Honorable Judge Miranda M. Du on 2/17/2026. By Deputy Clerk: Karen Walker.The parties do not dispute that Petitioner retained counsel for his initial bond hearing on May 13, 2025, that his counsel did not appear, and that the Immigration Judge ("IJ") proceeded with the bond hearing regardless. (ECF Nos. 1 -1 at 3, 13 at 3-4, 17 at 2.) It is not clear from the provided factual record whether the IJ may have abused her discretion by violating Petitioner's statutory right to counsel. See 8 U.S.C § 1362; Hernandez-Gil v. Gonzales, 476 F.3d 803, 808 (9th Cir. 2007). In executing its habeas corpus jurisdiction, the Court shall "summarily hear and determine the facts" including by fashioning "methods for securing facts where necessary." Harris v. Nelson, 394 U.S. 286, 299 (1969) (quoting 28 U.S.C. § 2243). The Court therefore orders Respondents to provide the Court and Petitioner with a transcript or recording of Petitioner's initial bond hearing by noon on Friday, February 20, 2026. See Martinez v. Clark, 124 F.4th 775, 786 (9th Cir. 2024) ("Due process requires immigration courts to make contemporaneous records of bond hearings." (citing Singh v. Holder, 638 F.3d 1196, 1200 (2011))). ORDERIt is therefore ordered that Quintana Chagolla's Petition (ECF No. 1 -1) is granted. Respondents must immediately release Quintana Chagolla no later than 5:00 PM on Thursday, February 26, 2026, subject to reasonable terms of supervisio n. See 8 U.S.C. §§1231(a)(6), (a)(3). Determining reasonable terms of supervision shall not in any way impede the immediate release of Quintana Chagolla. It is further ordered that the parties shall file a joint status report by Friday, February 27, 2026 confirming Respondents compliance with this Order. The Clerk of Court is kindly directed to serve a courtesy copy of this Order to Chief of Warden John Mattos at the Nevada Southern Detention Center as well as the Office of th e United States Attorney for the District of Nevada.
