TEXT ORDER. Pro se petitioner seeks relief under 28 U.S.C. § 2241. Dkt. 1. He also moved for a temporary restraining order ("TRO") (Dkt. 3) and for an order to show cause and an expedited hearing (Dkt. 4). The TRO motion asks the Court to: (1) order an immediate bond hearing; (2) require ICE to justify continued detention; and (3) grant any other appropriate relief. Dkt. 3, at 4. The Court grants the motion for expedited hearing, to the extent of setting the following schedule. Respondents shall respond to the petition and the TRO motion by August 19, 2026, and Petitioner's reply is due by August 26, 2026. In their filings, the parties shall address whether and how the Second Circuit's decision in Da Cunha v. Freden, 175 F.4th 61 (2d Cir. 2026), applies. The Clerk of Court shall serve a copy of the petition (Dkt. 1), the TRO motion (Dkt. 3), and a copy of this text order, electronically via a Notice of Electronic Filing to the United States Attorney's Office, Western District of New York at USANYW-Immigration-Habeas@usdoj.gov.
