Judge Indira Talwani: ELECTRONIC ORDER: Petitioner Kelusodi Eduardo Filemon was detained by U.S. Immigrations and Customs Enforcement on December 8, 2025 and is currently being held in custody in the District of Massachusetts. See Pet. ¶¶ 17–18 [ 1 ]. Where the government asserts that Petitioner is entitled to a bond hearing pursuant to 8 U.S.C. § 1226(a), see Resp. [ 6 ], the court agrees and orders that Petitioner must be provided a bond hearing no later than December 18, 2025. If the immigration judge declines to conduct a bond hearing, Respondents shall so advise the court by that date so that this court may conduct the bond hearing. Any decision by the immigration judge to retain Filemon in custody following a bond hearing pursuant to 8 U.S.C. § 1226 shall set forth the reasons for the continued detention.(SEC) (Entered: 12/11/2025)
