The Clerk of the Court shall serve a copy of this order, a copy of petitioner's application for a writ of habeas corpus pursuant to 28 U.S.C. § 2241, and petitioner's motion for temporary restraining order on the United States Attorney.Respondents shall file any Opposition to the Motion for Temporary Restraining Order on or before December 16, 2025, by 5:00 p.m. Petitioner may file a Reply on or before December 18, 2025, by 5:00 PM. The parties shall indicate in their briefing their position as to whether the motion for temporary restraining order should be converted to a motion for preliminary injunction without additional briefing. The matter is not set for a hearing though the Court may set one should it later determine that a hearing is necessary.To ensure this court's jurisdiction to resolve the pending Motion for Temporary Restraining Order and the 28 USC § 2241 habeas petition, respondent shall not transfer petitioner out of this judicial district, pending further order of the court. See 28 U.S.C. § 1651(a) (establishing the All Writs Act which empowers the federal courts to "issue all writs necessary or appropriate in aid of their respective jurisdictions...."); see also F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (emphasizing that federal courts have the power to "to preserve the court's jurisdiction or maintain the status quo by injunction pending review of an agency's action"). MINUTE ORDER signed by Magistrate Judge Chi Soo Kim on 12/18/2025: Respondents did not timely respond to the Courts 12/17/2025 Minute Order (ECF No. 12), and submitted an explanation for Respondents delay (ECF No. 14), which the Court accepts. Respondents counsel is directed to take measures to ensure counsel receives prompt notice of the Courts orders, which are filed and served through the CM/ECF system, and is critical in cases like this where time sensitive motions are filed such as TRO motions. In addition, Respondents did not submit any documents with their Opposition (ECF No. 11). By 5:00 pm on 12/18/2025, Respondents are ORDERED to file copies of all portions of Petitioner's A-File and other supporting documents referenced in or related to Respondents Opposition (ECF No. 11), including copies of all orders of release and all detention orders.
