ENDORSED ORDER. On August 18, 2026, Federal Respondents, including Markwayne Mullin, Secretary of the Department of Homeland Security ("DHS"), filed a Response (Doc. 5) conceding that Petitioner is detained under 8 U.S.C. § 1226(a) and is entitled to an individualized bond redetermination hearing. On September 1, 2026, Petitioner filed a Reply (Doc. 6) advising that on August 31, 2026, an immigration judge conducted a full bond hearing for Petitioner and ordered his release upon posting a $1,500 bond. Petitioner, however, asserts that immediately after that ruling, DHS filed a Form EOIR-43, automatically staying the immigration judge's bond order, resulting in Petitioner's continued confinement. In other words, DHS's actions appear to be materially inconsistent with its representations and concessions made in this case. As such, by September 4, 2026, Federal Respondents must file a supplement explaining this apparent inconsistency and advising how the Court should proceed. Signed by Judge Wendy W. Berger on 9/2/2026. (JND) (Entered: 09/02/2026)
