MEMORANDUM AND ORDER granting 2 MOTION for Temporary Restraining Order, granting 1 Petition for Writ of Habeas Corpus; granting 12 EMERGENCY MOTION for Summary Judgment, denying as moot 8 MOTION for Extension of Time to Answer and Respond, denying 9 MOTION for Summary Judgment and Response to Habeas Petition and Motion for Temporary Restraining Order. Respondents must release Petitioner within twenty-four (24) hours after this Order is entered, under the same conditions that were in effect in his previous Order of Supervision, except that he is expressly permitted to travel within the United States to see his ailing father. Respondents must notify his counsel of the exact time and location of release no less than four hours before his release. Petitioner shall not be re-detained without a showing that there has been a material change in circumstances, for example, a showing that Petitioner's documents are complete and ready for travel, that China has agreed to accept Petitioner's removal to China, and that Petitioner is scheduled for a flight to China.The 5-day notice provision from the Court's December 16, 2025 Order, REMAINS IN EFFECT. No later than two (2) days after Petitioner's release, the parties shall provide the Court with a status update concerning Petitioner's release. The parties should also notify the Court of the conditions, if any, of his release.Within five (5) days of the Petitioner's release, the parties shall file a joint status update and indicate whether this case may be closed.
