MEMORANDUM ORDER - IT IS HEREBY ORDERED that Petitioner's Motion at ECF No. 1 is DENIED insofar as Petitioner seeks injunctive relief barring his transfer to another facility, and insofar as Petitioner seeks a T.R.O. However, the Court will proceed to consider Petitioner's Motion in so much as it requests relief via a P.I. based upon his remaining claim that he cannot be detained pursuant to § 1225(b)(2) and must be released. IT IS FURTHER ORDERED that Petitioner shall serve his filings at ECF Nos. 1 and 2 upon Respondents as soon as possible. After service is effectuated, Petitioner shall electronically mail this Memorandum Order to counsel for Respondents. IT IS FURTHER ORDERED that Respondents shall file and serve a written response to Petitioner's Motion at ECF No. 1 within ten (10) days of receipt of service. Aside from any additional arguments Respondents wish to make, the Response shall specifically address: (1) what statute governs Petitioner's detention and why; (2) Matter of Yajure Hurtado, 29 I. & N. Dec. 216 (BIA 2025) and its position relative to the vast number of courts that have rejected the reasoning articulated therein; and (3) whether the Fifth Amendment's Due Process Clause requires that Petitioner be afforded the relief he is seeking. Petitioner may, but is not required to, file and serve a Reply to any Response submitted by Respondents within five (5) days of receipt of Respondents' Response. ORDER granting the 4 Petition for Writ of Habeas Corpus to the extent it seeks an individualized bond hearing before an immigration judge, and, in light of this relief, the 1 Motion for Temporary Restraining Order/Preliminary Injunction is moot. See Calzado Diaz v. Noem, No. 3:25- cv-458, 2025 WL 3628480 (W.D. Pa. Dec. 15, 2025) (Haines, J.), vacated as moot, ECF No. 22 (Dec. 17, 2025) (the legal conclusions in Calzado are unaffected by the mooting of the order due to the individual facts of Mr. Calzado Diaz's case); A.D. v. Leonard Oddo et. al., No. CV 25-460J, 2026 WL 101476, at *1 (W.D. Pa. Jan. 14, 2026). The Government is directed to provide Petitioner with the statutory process required under 8 U.S.C. 1226, which includes a bond hearing. The Government shall arrange for an individualized bond hearing to be conducted by an immigration judge by January 30, 2026. If Petitioner is not provided with a bond hearing by January 30, 2026, or if the immigration judge declines to conduct a bond hearing based on Hurtado, Respondents shall immediately release Petitioner from custody. The parties shall provide notice to the Court of the outcome of the individualized bond hearing within seven days of the date of the immigration judge's decision.
