MINUTE ORDER issued by Courtroom Deputy for Chief District Judge Troy L. Nunley on August 19, 2026: Before the Court is Petitioner's Petition for Writ of Habeas Corpus (ECF No. 1 ) and Notice of Related Case (ECF No. 8 ). Case No. 1:26-cv-00084-DAD-CSK and Case No. 1:26-cv-05999-TLN-JDP "involve the same petitioner and respondents, arise out of [the same claims], and thus involve the same questions of law and fact." (ECF No. 8 .) Moreover, it appears that in the first-filed case the magistrate judge provided appointed counsel an opportunity to file an amended petition (No. 1:26-cv-00084-DAD-CSK, ECF No. 21), but rather than filing in that case, counsel initiated a new case with a new petition involving the same parties, claims, and requested relief. Because the cases are duplicative and this action was filed later, the Court hereby dismisses the instant Petition for Writ of Habeas Corpus in this action without prejudice. The Court will rule on the Petition in the first filed case (No. 1:26-cv-00084-DAD-CSK). The Clerk of the Court is directed to close this case. CASE CLOSED.
