MINUTE ORDER (Text Only Entry) signed by District Judge Dale A. Drozd on 1/13/2026: Pending the issuance of the courts order resolving the pending 9 motion for temporary restraining order, and unless and until the court orders otherwise, the court ORDERS that respondents shall not take any action to remove petitioner from the United States or to move petitioner out of the Eastern District of California. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (acknowledging the courts express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction). Given the exigent circumstances present, the court finds that this order is warranted to maintain the status quo pending its forthcoming order resolving petitioners pending 9 motion for temporary restraining order. Further, in light of petitioners pro se status, the court DIRECTS the Clerk of the Court to serve a copy of petitioners motion for temporary restraining order 9, and a copy of this order to the United States Attorneys Office for the Eastern District of California by email at usacae.ecf2241-imm@usdoj.gov, by tomorrow, 1/14/2026 at 5 PM. Counsel for respondents shall promptly enter Notices of Appearance. Respondents shall file a written opposition to the pending 9 motion for temporary restraining order by 5:00 PM on Thursday, 1/15/2026. If the parties were to jointly agree upon a less demanding briefing schedule, the court will consider the parties proposal. (Deputy Clerk PAB) (Entered: 01/13/2026)

MINUTE ORDER issued by Courtroom Deputy for Magistrate Judge Allison Claire on 07/29/2026. On July 22, 2026, with assistance of newly retained counsel, petitioner filed an 24 amended petition for writ of habeas corpus and motion for temporary restraining order (TRO) asserting due process claims. As respondents have already filed a response to the petition (ECF No. 6 ), petitioner's filing is improper under Fed. R. Civ. P. 15(a)(2). Accordingly, the Clerk is directed to STRIKE the amended petition and TRO (ECF No. 24) as improperly filed. Petitioner may file a properly supported motion seeking leave to file an amended pleading and TRO that complies with the federal and local rules by Monday, August 3, 2026. In light of counsel's appearance and demonstrated intention to seek a TRO, petitioner's motion for appointment of counsel 17 is denied as moot and the pro se motion for TRO 16 is deemed superseded by ECF No. 24 and is therefore vacated. (Text Only Entry) (Deputy Clerk JAA) (Entered: 07/29/2026)

Respondents are directed to file a response to the amended petition and motion for temporary restraining order within 7 days from the date of this order. See 28 U.S.C. § 2243. If respondents dispute any factual representations in the operative petition/motion for temporary restraining order, the response shall include any and all documents necessary to support their view of the facts.
