TEXT ORDER: The Court is in receipt of Respondents' opposition to the Petition. (ECF No. 5). Respondents represent that Petitioner is detained pursuant to 8 U.S.C. § 1226(a) and is scheduled for a bond hearing on August 4, 2026, at 8:30 a.m. (Id. at 2 & 3 n.1). Accordingly, by August 5, 2026, at 5:00 p.m., Respondents shall file a submission confirming that the bond hearing occurred and the outcome thereof. If bond is denied, Respondents shall submit by the same date and time an order from the appropriate administrative authority reflecting the outcome of the bond hearing and transcript of the bond hearing. If the order and transcript are not readily available, then counsel shall certify as to such and the order and transcript shall be filed promptly thereafter, but no later than three (3) days thereafter. Upon confirmation that the bond hearing has occurred, the operative Petition, (ECF No. 1), will be denied as moot. If bond is denied, Petitioner may file an amended pleading within fourteen (14) days of Respondents' submission to the Court confirming the outcome of the bond hearing, to assert any further claims. If Petitioner fails to file an amended pleading within that time, the Court's no-transfer order, (ECF No. 2), will be vacated. So Ordered by Judge Christine P. O'Hearn on 8/3/2026. TEXT ORDER: This matter comes before the Court upon Petitioner's Petition for Writ of Habeas Corpus, in which he alleges that his detention without a bond hearing is unlawful. (See generally ECF No. 1). In light of Respondents' representation that Petitioner has since received a bond hearing and that an immigration judge has set bond, (ECF No. 8), the Petition, (ECF No. 1), is DENIED WITHOUT PREJUDICE as moot. Petitioner may file an amended petition to assert any further claims within fourteen (14) days of the date of this Order. During that period, the Court's no-transfer order, (ECF No. 2), shall remain in effect. If Petitioner does not file an amended petition within fourteen (14) days, the no-transfer order shall be vacated and the Clerk of the Court shall close this matter. So Ordered by Judge Christine P.
