TEXT ORDER: The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Nnenna Ogu Uduma ("Petitioner") who is currently detained at the Elizabeth Contract Detention Facility. (ECF No. 1.) According to the Petition, Petitioner is a noncitizen who lawfully entered the United States pursuant to a B-2 visitor visa and is presently detained by U.S. Immigration and Customs Enforcement. Petitioner alleges that she has no criminal history, is married to a United States citizen, and has pending applications for adjustment of status and employment authorization before United States Citizenship and Immigration Services ("USCIS"). Petitioner further alleges that she suffers from significant medical conditions, including adenomyosis, abnormal uterine bleeding, ovarian cysts, and polycystic ovary syndrome ("PCOS"), and that she requires ongoing medical evaluation, diagnosis, and surgical planning. According to the Petition, continued detention has delayed or impaired her ability to obtain necessary medical care and places her health at substantial risk. Petitioner contends that, under these circumstances, her continued civil immigration detention violates the Due Process Clause of the Fifth Amendment. (Id.) The Court finds that the Petition raises substantial constitutional questions regarding the legality of Petitioner's continued detention and the adequacy of the medical care available to her while in immigration custody. In light of Petitioner's allegations that she suffers from serious medical conditions requiring timely evaluation and treatment, Respondents shall file a response to the Petition within three (3) days of the entry of this Order addressing: (1) the statutory basis for Petitioner's detention; (2) whether Petitioner is eligible for release or an individualized custody determination; and (3) the medical care currently being provided to Petitioner, including whether she has been evaluated by appropriate medical professionals, the treatment she has received, any recommended diagnostic testing or surgical consultation, and whether arrangements have been made to ensure continuity of medically necessary care. Respondents shall attach all relevant custody records and medical records in their possession relating to Petitioner's detention and treatment. Respondents shall not transfer Petitioner outside the District of New Jersey without prior leave of Court.
