Petitioner last entered the United States in September of 2023 on a B-2 tourist visa. Within one year of his entry, Gomes filed an affirmative application for asylum with U.S. Citizenship and Immigration Services (USCIS). He has no criminal history and has not been arrested, charged, or convicted of any criminal offense in the United States or elsewhere. On July 23, 2026, ICE immigration officers arrested Petitioner in Augusta, Maine, and have detained him at the Plymouth County Correctional Facility. His counsel argues that his detention is illegal as he was arrested on a post-dated warrant. ICE has commenced removal proceedings and he is scheduled to appear before the Chelmsford Immigration Court for a Master Hearing on August 11, 2026, at 9:00 a.m. Gomes is not under a Final Order of Removal. The government agrees that Gomes is entitled to a bond hearing. The government must arrange a bond hearing for Catarino Gomes before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case later than Friday August 14, 2026. The court directs the parties to report to the court within 48 hours of a decision from the Immigration Judge in this matter. (MZ) (Entered: 08/10/2026)
