To ensure this Court's jurisdiction to resolve the pending § 2241 petition, Respondents shall not transfer Petitioner to another detention center outside of this judicial district, pending further order of the Court. MINUTE ORDER (Text Only Entry) issued by Courtroom Deputy for Magistrate Judge Sean C. Riordan on 9/4/2026: The Office of the Federal Defender contacted the Court with concerns about the status of Petitioner's removal proceedings. The Court sua sponte appoints Petitioner counsel in the interests of justice for the limited purpose of determining the status of any appeal of the August 12, 2026 immigration judge's order of removal and the impact of any such appeal on Petitioner's habeas claims. See 18 U.S.C. § 3006A(a)(2)(B); see also Weygandt v. Look, 718 F.2d 952, 954 (9th Cir. 1983). The Court hereby appoints the Federal Defender to represent Petitioner for this limited purpose. The parties are ordered to submit simultaneous briefs, along with any relevant evidence, within 7 days from the date of this order, which shall address whether the Court's August 17, 2026 Minute Order lifting the no-transfer provision in this case should be reconsidered and whether any appeal affects Petitioner's substantive habeas claims. MINUTE ORDER (Text Only Entry) issued by Courtroom Deputy for Magistrate Judge Sean C. Riordan on 9/17/2026: Having reviewed the parties' supplemental briefs and new evidence submitted, the Court vacates its August 17, 2026 Minute Order (ECF No. 10 ) lifting the no transfer provision in this case as there remains a controversy concerning the detention authority governing Petitioner's case. In order to ensure this court's jurisdiction to resolve the pending amended § 2241 petition, Respondent shall not transfer Petitioner to another detention center outside of this judicial district, pending further order of the court. See 28 U.S.C. § 1651(a) (establishing the All Writs Act which empowers the federal courts to "issue all writs necessary or appropriate in aid of their respective jurisdictions...."); see also F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (emphasizing that federal courts have the power to "to preserve the court's jurisdiction or maintain the status quo by injunction pending review of an agency's action").
