Petitioner Adebayo Anthony Fagbemi has been detained by U.S. Immigration and Customs Enforcement (ICE) for more than 18 months he is currently at Plymouth County House of Corrections and has asked for his release. An Immigration Judge granted Fagbemi asylum status on June 25, 2026; ICE has appealed that decision. The court orders the government to arrange a bond hearing for Adebayo Anthony Fagbemi before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case later than Tuesday August 11, 2026. On June 25, 2026, Petitioner Fagbemi was granted Asylum, Withholding of Removal under the Immigration andNationality Act and Withholding of Removal under the Convention Against Torture by an Immigration Judge (IJ). DKt 1-1 at 2. On July 24, 2026, ICE appealed the IJ's decision to the Board of Immigration Appeals (BIA). Dkt 1-2 at 5 para. 20. At a separate hearing, an IJ denied Petitioner's request for bond.
