ORDER re 1 Petition for Writ of Habeas Corpus, filed by Wilson Fernando Marroquin-Alegria. On July 24, 2026, Petitioner filed a Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241. ECF No. 1. Respondents do not oppose an order from this Court directing a bond hearing be held pursuant to 8 U.S.C. § 1226(a). ECF No. 4 at 2. Accordingly, the Court GRANTS the petition for a writ of habeas corpus. Respondents shall immediately release Petitioner under the previously determined conditions. Respondents are enjoined from re-detaining Petitioner without complying with due process. Petitioners request for attorneys fees and costs is DENIED without prejudice to Petitioner filing an appropriate application for fees. AMENDED ORDER by the Honorable Benjamin J. Cheeks re 1 Petition for Writ of Habeas Corpus, filed by Wilson Fernando Marroquin-Alegria. On July 24, 2026, Petitioner filed a Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241. Respondents do not oppose an order from this Court directing a bond hearing be held pursuant to 8 U.S.C. § 1226(a). ECF No. 4 at 2. Petitioner asserts he was released from immigration custody in 2017 and permitted to remain at liberty in the United States subject to certain conditions. He further asserts he was detained without notice or an opportunity to challenge the decision. The Court finds immediate release appropriate. Accordingly, the Court GRANTS the petition for a writ of habeas corpus. Respondents shall immediately release Petitioner under the previously determined conditions. Respondents are enjoined from re-detaining Petitioner without complying with due process. Petitioners request for attorneys fees and costs is DENIED without prejudice to Petitioner filing an appropriate application for fees. The Clerk of Court shall close this matter.
