Petitioner Kervens Datus is a 24-year-old citizen of Haiti who has been in custody at the Plymouth County House of Correction since August 13, 2025. He filed this pro se habeas petition on July 23, 2026. The court agrees with Mr. Datus that he is entitled to a bond hearing. He has been in custody nearly a year. See Zadvydas v, David, 533 U.S.678 (2001). The government must arrange a bond hearing for Kervens Datus before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case later than Tuesday August 4, 2026.
