This Court will DENY Petitioners Motion in so much as it requests relief via a T.R.O. as a T.R.O. is not the appropriate vehicle for the relief requested. However, the Court will consider Petitioners claims in so much as he seeks a P.I. Respondents shall file and serve a written response to Petitioners Motion for a Temporary Restraining Order and Preliminary Injunction no later than 11:59 PM on December 12, 2025. Aside from any additional arguments Respondents wish to make, the Response shall specifically address: (1) what statute governs Petitioners detention and why and (2) how Petitioners family-based[,] adjustment of status petitions impact his removal proceedings. TEXT ORDER - On December 4, 2025, counsel filed a "Memorandum of Law in Support of Plaintiff's Emergency Motion for Temporary Restraining Order and Preliminary Injunction." ECF No. 1 . No separate motion accompanied the memorandum, no separate order as required by Local Civil Rule 6 was attached, no petition seeking habeas relief has been filed, and no filing fee has been received. A habeas case is commenced by the filing of a petition, which has not occurred in this case. See Local Civil Rule 2241.B. Accordingly, a Petition and filing fee must be received by January 23, 2026, or it will be recommended this case be dismissed without prejudice.
