This Court will DENY Petitioners Motion in so much as it requests relief via a T.R.O. as a T.R.O. is not the appropriate vehicle for the relief requested. However, the Court will consider Petitioners claims in so much as he seeks a P.I. Respondents shall file and serve a written response to Petitioners Motion for a Temporary Restraining Order and Preliminary Injunction no later than 11:59 PM on December 12, 2025. Aside from any additional arguments Respondents wish to make, the Response shall specifically address: (1) what statute governs Petitioners detention and why and (2) how Petitioners family-based[,] adjustment of status petitions impact his removal proceedings. TEXT ORDER - On December 4, 2025, counsel filed a "Memorandum of Law in Support of Plaintiff's Emergency Motion for Temporary Restraining Order and Preliminary Injunction." ECF No. 1 . No separate motion accompanied the memorandum, no separate order as required by Local Civil Rule 6 was attached, no petition seeking habeas relief has been filed, and no filing fee has been received. A habeas case is commenced by the filing of a petition, which has not occurred in this case. See Local Civil Rule 2241.B. Accordingly, a Petition and filing fee must be received by January 23, 2026, or it will be recommended this case be dismissed without prejudice. Additionally, it is not evident from the docket whether counsel has complied with the December 18, 2025, Order issued by Judge Stephanie L. Haines that counsel must serve ECF No. 1 upon Respondents within five (5) days of her Order. ECF No. 3 .
