TEXT ORDER - Before the Court is Respondents' letter seeking amendment of the Court's July 23, 2026 no transfer Order to allow Respondents to transfer Petitioner to another detention center within the region. (ECF No. 9 .) Respondents submit that they seek an amendment of the Court's no transfer Order so Petitioner will feel "safe." (See ECF No. 10 .) Petitioner has opposed Respondents' letter request. (ECF No. 12 .) As Petitioner opposes the transfer to another facility, the Court will deny Respondents' letter request. Also before the Court is Petitioner's Motion to Enforce the Court's no transfer Order and seeking Petitioner's immediate release from custody based on his August 5, 2026 transfer from Delaney Hall Detention Facility to Elizabeth Contract Detention Facility. (See ECF No. 13 .) On August 10, 2026, Respondents informed the Court that Immigrations and Customs Enforcement ("ICE") transferred Petitioner to Elizabeth Contract Detention Facility in violation of the Court's July 23, 2026, Order prohibiting Petitioner's transfer. (See ECF No. 8 .) Respondents submit that upon learning of Petitioner's transfer, Respondents immediately began working to facilitate Petitioner's return to Delaney Hall. (Id.) Petitioner was returned to Delaney Hall Detention Facility on August 7, 2026. (Id.) As Respondents informed the Court of Petitioner's transfer and effectuated Petitioner's return to Delaney Hall, the Court will deny Petitioner's Motion to Enforce and for immediate release from custody. Accordingly, it is ORDERED that Respondents' letter request for amendment of the Court's July 23, 2026 no transfer Order (ECF No. 9) is DENIED.
