District Judge Patti B. Saris: ELECTRONIC ORDER entered. Petitioner Manuel Maria Quizhpi-Namina ("Petitioner") has filed a habeas petition under 28 U.S.C. § 2241 alleging that the bond hearing he received in immigration court did not comport with the due process standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021). The government's answer solely addresses Petitioner's entitlement to a bond hearing, see Dkt. 9, which is not responsive to the arguments raised in the petition. The Court therefore gave the government a second opportunity to respond to the petition. See Dkt. 10. While the government provided a recording of the bond hearing and the evidence submitted to the immigration court, the government did not file a supplemental answer. Given the government's failure to respond to Petitioner's arguments, the Court ALLOWS the habeas petition (Dkt. 1) without opposition. The Court ORDERS the government to release Petitioner immediately and no later than 12:00 p.m. tomorrow, August 14, 2026. This order is without prejudice to the government requiring Petitioner to comply with reasonable conditions of supervision.
