Warden, California City Correctional Center, 1:26-cv-05696-DC-CSK ("Xie II"), Petitioner Jiaxing Xie (A-249-119-098) indicates that he filed an earlier habeas action in the United States District Court for the Southern District of California on 3/5/2026, Xie v. Larose, et al., 3:26-cv-01421-LL-BLM ("Xie I"). After reviewing the filings in each case, the court finds that Xie II involves the same Petitioner, alleges nearly identical facts, and requests nearly identical relief as Xie I. A court may dismiss one action as duplicative of another. See M.M. v. Lafayette Sch. Dist., 681 F.3d 1082, 1091 (9th Cir. 2012). Because this action is essentially identical to the earlier filed case, this case (1:26-cv-05696-DC-CSK) is DISMISSED AS DUPLICATIVE.
