MINUTE ORDER: On July 21, 2026, Petitioner filed a habeas petition, alleging that he is unlawfully detained at the Imperial Regional Detention Facility located in this District. ECF No. 1. On July 29, 2026, Respondents filed a return to the Petition. ECF No. 4 On August 4, 2026, Petitioner filed an emergency motion to enforce, stating that Petitioner was transferred to a detention facility in San Luis, Arizona, after submitting his habeas petition to this Court. ECF No. 6. This transfer is a direct violation of this Court's Minute Order (ECF No. 3) adopting Chief Judge Order No. 144, which states "Respondents shall not transfer Petitioner outside the Southern District of California unless the Court orders otherwise." Moreover, the transfer does not divest this Court of jurisdiction over this petition, as jurisdiction attaches on the initial filing for habeas corpus relief. Francis v. Rison, 894 F.2d 353, 354 (9th Cir. 1990). Thus, a subsequent transfer does not destroy the jurisdiction established at the time of filing. Johnson v. Gill, 883 F.3d 756, 761 (9th Cir. 2018). Because Petitioner was transferred after filing a habeas petition in this District, the Court finds that it retains jurisdiction over the petition despite the transfer.
