ORDER DENYING PETITION FOR WRIT OF HABEAS CORPUS. The current Petition for Writ of Habeas Corpus 1 is Petitioner's second attempt to receive a bond hearing after this Court granted him one in a related case, found at Docket No. 26-cv-00784. Petitioner was denied bond due to being deemed a flight risk in that case. He now submits an almost identical Petition, that boldly asserts he has not been afforded a meaningful opportunity to challenge the continued necessity of his detention," and that seeks his immediate release. Petitioner does not challenge the validity of the bond hearing he previously received, instead he acts like it never occurred. A second Petition for Writ of Habeas Corpus filed pursuant to 28 USC 2241 cannot re-submit identical arguments that have been considered in a previous Writ under the abuse-of-the-writ doctrine." Queen v. Miner, 530 F.3d 253, 255 (3d Cir. 2008). Because Petitioner here attempts to re-submit identical arguments that the Court previously considered in his original action, that doctrine bars further relief here, and the writ is DENIED. The case will be marked CLOSED. Signed by Judge Mark R. Hornak on 7/31/26. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. (bdb) (Entered: 07/31/2026)
