TEXT ORDER. On July 22, 2026, the Court entered an Order to Show Cause that directed, among other things, that Petitioner remain within the Western District of New York. ECF No. 2. Shortly after the Petition and Order were served on Respondents, Respondents notified the Court that Petitioner had already been transferred out of the District before the Order was issued. For the reasons set forth in the Order to Show Cause, Respondents are directed to transfer Petitioner back to the District, or to the nearest facility to the District that houses female immigration detainees. TEXT ORDER granting 1 Petition for a writ a habeas corpus and ordering Petitioner's release from custody. On July 31, 2026, the Court held a status conference with counsel for the parties to address Petitioner's July 27 letter, seeking release pending adjudication of her petition given conditions of confinement at the Louisiana facility where she is housed. ECF No. 6. That requested relief is denied as moot given this Order, resolving her underlying petition. During the conference, Petitioner's counsel raised an additional issue that, at the time of Petitioner's arrest on July 20, 2026, the only Notice to Appear ("NTA") that had been issued against Petitioner was from 2023, and that the removal proceedings that had been initiated as of result of that NTA had since been terminated. Counsel for Respondents acknowledged those facts and proffered that the circumstances of this case implicated this Court's recent decision in Loaeza v. Bausch, et al., to warrant Petitioner's immediate release. No. 26-CV-00945-MAV, 2026 WL 2150155 (W.D.N.Y. July 27, 2026) (ordering petitioner's immediate release where 8 U.S.C. § 1226(a) governed his detention and his NTA was issued, served, and filed with the Executive Office for Immigration Review (EOIR) all after Petitioner was arrested and, thus "[u]nder these circumstances, it is clear that when Mr. Loaeza was arrested, there were no removal proceedings pending against him."). Respondents' previously filed return to the Courts Order to Show Cause conceded that § 1226(a) governed Petitioner's detention and argued that a bond hearing with the burden on Petitioner was the only appropriate remedy in this case pursuant to the Second Circuit's decision in Barbosa da Cunha v. Freden, 175 F.4th 61, 69 (2d Cir. 2026). ECF No. 7. Based upon the parties' arguments during the conference, the Court directed Respondents to supplement their return, updating their position on the relief deemed warranted by the facts of this petition. Respondents filed a brief letter, with supporting documentation, stating that "at the time of the arrest of Petitioner, there were no ongoing removal proceedings," and quoting the Loaeza decision as follows: "In other words, without a valid NTA in place, removal proceedings are not pending, and Respondents have no authority to make an arrest or effectuate detention pursuant to § 1226(a)." ECF No. 9 at 1.Based upon Respondents' updated position as articulated during the July 31 conference and in their subsequent letter at ECF No. 9, the Court ORDERS Respondents to release Petitioner from custody on the following terms. Respondents shall transport Petitioner back to the Western District of New York for release within five (5) days of this Order and shall notify Petitioner's counsel at least 72 hours prior to Petitioner's release from custody of the location, date, and approximate time that Petitioner will be released to allow Petitioner to affect any further transport as needed.
