TEXT ORDER - The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner Santos Ervin Guinea Garcia ("Petitioner"), who is currently detained at the Delaney Hall Detention Facility in Newark, New Jersey. (ECF No. 1.) Petitioner alleges that on July 14, 2026, he was arrested by Immigration and Customs Enforcement on his way to work, and that he has since been detained at Delaney Hall Detention Facility without a bond hearing. Petitioner further alleges that Respondents seek to remove or transfer him before he has a meaningful opportunity to present a defense. Petitioner contends that his continued detention is unlawful, arbitrary, capricious, and violates the Due Process Clause of the Fifth Amendment. (Id.) Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, within seven (7) days of the entry of this Order, why the Petition (ECF No. 1) should not be granted, and shall file with their response all portions of the administrative record necessary for the Court's review. Petitioner may file a reply within three (3) days after service of Respondents' response. Respondents shall not transfer Petitioner outside the District of New Jersey during the pendency of these proceedings. So Ordered by Judge Karen M. Williams on July 21, 2026.
