FINDINGS and RECOMMENDATIONS signed by Magistrate Judge Chi Soo Kim on 8/17/2026 RECOMMENDING that the 1 Petition for Writ of Habeas Corpus be granted on claims one and that Respondents be ordered to immediately release petitioner and be ordered to provide petitioner with a copy of the release order at or near the time of release. If respondents have custody of petitioner's documents, respondents shall return those to petitioner at the time of release. It is FURTHER RECOMMENDED that Respondents be enjoined and restrained from re-detaining petitioner unless the government demonstrates, by clear and convincing evidence at a pre-deprivations bond hearing before a neutral decisionmaker, that petitioner is a flight risk or danger to the community such that his physically custody is legally justified and that the Clerk of the Court be directed to close case and enter judgment in favor of petitioner. Referred to Judge Dale A. Drozd. Objections to these Findings and Recommendations are due within 7 days of the date of these Findings and Recommendations. (Deputy Clerk OML) (Entered: 08/17/2026)
