TRANSFER ORDER: In his 1 Petition & Affirmation for a Writ of Habeas Corpus, Petitioner challenges his ongoing detention by the U.S. Department of Homeland Security at the Delaney Hall Detention Facility in Newark, New Jersey. Although Petitioner states that he resides in Suffolk County, New York, it is well settled that 28 U.S.C. § 2241 requires a habeas petitioner challenging his present physical confinement to file a petition in the district of confinement. See Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004); Trump v. J.G.G., 604 U.S. 670, 672 (2025) (per curiam). Venue in this District is therefore improper. The Clerk of Court is directed to transfer this action to the U.S. District Court for the District of New Jersey and to close this matter. The Court waives compliance with Local Rule 83.1, which otherwise imposes a seven-day delay in the effectuation of the transfer. Ordered by Judge Orelia E. Merchant on 7/20/2026. (TSB)
