MINUTE ORDER IN CHAMBERS of the Honorable District Judge Anne R. Traum on 7/20/2026. Petitioner has filed a habeas petition (ECF No. 1 ) and a motion for a Temporary Restraining Order (ECF No. 2 ). She alleges that she is subject to a final removal order and at risk of imminent removal before the Petition can be resolved. She seeks an injunction staying removal until the resolution of this case, among other relief. The Court has jurisdiction to grant a stay of removal under the All Writs Act, 28 U.S.C. § 1651. Courts have long recognized that 8 U.S.C. § 1252(g) does not insulate the Government from judicial review when a petitioner alleges that immigration officials have acted outside of their lawful discretion, beyond the limits imposed by statute, regulation, or the Constitution. See Ibarra-Perez v. United States, 154 F.4th 989, 996 (9th Cir. 2025) (holding that Section 1252(g) only strips courts of jurisdiction to interfere with the Attorney General's lawful exercises of discretionary authority). It is ordered that in order to maintain jurisdiction and provide a prompt resolution, Respondents shall not transfer Petitioner out of this District or remove her unless the Court grants a motion or stipulation to modify this order.
