TEXT ORDER - The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner Elser Oreste Miguel Henriquez ("Petitioner"), who is currently detained at the Delaney Hall Detention Facility in Newark, New Jersey. (ECF No. 1.) Petitioner alleges that he is a 19-year-old Honduran national who was granted deferral of removal under the Convention Against Torture by an Immigration Judge on December 9, 2022, rendering his removal order administratively final. He contends that the statutory removal period expired in 2023, after which he remained at liberty in the community for more than three years without incident. Petitioner further alleges that ICE arrested him on July 9, 2026, without serving a judicial or administrative warrant, written custody determination, or notice revoking his prior release, and that he has since been detained at Delaney Hall Detention Facility without the custody reviews and procedural safeguards required by 8 C.F.R. §§ 241.4 and 241.13. Petitioner asserts that his removal is not reasonably foreseeable because he remains protected from removal to Honduras under the Convention Against Torture and no third country has agreed to accept him. He therefore contends that his continued detention is unlawful under 8 U.S.C. § 1231(a)(6), the Due Process Clause, and Zadvydas v. Davis, 533 U.S. 678 (2001). (Id.) Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, within three (3) days of the entry of this Order, why the Petition (ECF No. 1) should not be granted, and shall file with their response all portions of the administrative record necessary for the Court's review. Petitioner may file a reply within two (2) days after service of Respondents' response. Respondents shall not transfer Petitioner outside the District of New Jersey during the pendency of these proceedings. So Ordered by Judge Karen M. Williams on July 20, 2026.
