ORDER ENTERED: The Court requires sufficient time to consider the petition for habeas corpus filed pursuant to 28 U.S.C. § 2241. Consequently, the respondents shall not remove or transfer the petitioner outside of the District of New Hampshire unless they provide this Court with notice at least seventy-two hours in advance of any such removal or transfer. ENDORSED ORDER 7 Notice of Transfer Prior to Filing of Petition. Text of Order: To the extent doc no. 7 seeks dismissal or transfer of this action on the ground that petitioner was not confined in New Hampshire at the time of the petition's filing, respondents overlook that the petition is deemed filed on the date petitioner provided it to jail officials for mailing, not the date this court received his petition. Morales-Rivera v. United States, 184 F.3d 109, 109 (1st Cir. 1999) (per curiam); 2254 Rules, Rule 3(d) ("A paper filed by an inmate confined in an institution is timely if deposited in the institution's internal mailing system on or before the last day for filing."); Rule 1(b) (courts may apply 2254 Rules to petitions governed by 8 U.S.C. 2241). Petitioner's pleadings are dated July 10, 2026, and respondents have submitted no evidence that petitioner provided his pleadings to jail officials for mailing on some later date. The exhibits to the petition include a printout from ICE's online detainee locator demonstrating that petitioner was confined in New Hampshire on July 10. Doc. no. 1-2 at 1. And respondents themselves assert that petitioner was not transferred out of New Hampshire until July 13. Doc. no. 7-1 at 2. Because petitioner was confined in New Hampshire at the time he provided his petition to jail officials for mailing, jurisdiction attached in this court at that time, and his subsequent transfer out-of-district did not deprive this court of jurisdiction. Williams v. Warden, FCI Berlin, 786 F. Supp. 3d 436, 446, 450 (D.N.H. 2025). For these reasons, doc. no. 7 is denied to the extent respondents intended to move this court for relief. See also LR 7.1(a)(1) (all pleadings moving the court to grant relief must be captioned as such). Respondents shall comply with the requirements set forth in the service order (doc no. 4) by 4:00 p.m. on today's date. So Ordered by Judge Landya B. McCafferty.(vln)
