MINUTE ORDER signed by District Judge Edward J Davila on 8/30/2026: Upon review of the petition, it appears Petitioner previously filed a petition for writ of habeas corpus in the Middle District of Florida under Case No. 26-cv-01120-MMH-LLL, which was granted on 8/4/2026. In that Order, Judge Howard ordered that Petitioner be released from custody and placed on his existing order of supervision. See Dkt. No. 12 at 5. As such, Respondents are ORDERD to provide a supplemental response by 9/3/26 indicating whether Petitioner has been released from custody. MINUTE ORDER signed by District Judge Edward J Davila on 9/9/2026: Respondents' Motion to Dismiss is GRANTED pursuant to the first-to-file rule. Under the first-to-file rule, when two qualifying cases are filed in different districts, "the second district court has discretion to transfer, stay, or dismiss the second case in the interest of efficiency and judicial economy." In re Bozic, 888 F.3d 1048, 1051-52 (9th Cir. 2018) (quoting Cedars-Sinai Med. Ctr. v. Shalala, 125 F.3d 765, 769 (9th Cir. 1997)). District courts consider "three threshold factors in deciding whether to apply the first-to-file rule: (1) the chronology of the two actions; (2) the similarity of the parties; and (3) the similarity of the issues." Krikorian v. Post Consumer Brands, LLC, No. CV 25-2122-JFW (JRPx), 2025 WL 2092825, at *2 (C.D. Cal. June 25, 2025) (citations omitted). Here, all three factors support dismissal of this action: Petitioner filed a habeas petition in the Middle District of Florida before the petition pending before this court. See Valdes v. Warden, Case No. 26-cv-01120-MMH-LLL. The Florida Court granted the petition and ordered Petitioner's release on August 4, 2026. Respondents have confirmed that Petitioner was released from custody. Because Petitioner was granted the relief he seeks here by the Middle District of Florida court, this Court sees no reason to deviate from the first-to-file rule and issue a further ruling. Accordingly, the petition is DISMISSED WITHOUT PREJUDICE. This Order in no way prohibits Petitioner from filing a renewed habeas petition upon changed circumstances. This order resolves all pending motions. The Clerk of the Court is directed to close this case. (Text Only Entry) (CASE CLOSED) (Thomas, Julia) (Entered: 09/09/2026)
