Petitioner asserts that he has been detained since October 30, 2025. Despite that his detention began more than 3 months ago and that his petition was filed 2 months ago, he fails to explain his delay in seeking his request for a temporary restraining order or why this delay should cause this Court to treat the situation as an emergency. MINUTE ORDER (Text Entry Only) The Court has read and considered Petitioner's second request for temporary restraining order (Doc. 16 ) filed as a result of the Court denying the nearly identical request just days ago. If petitioner is seeking reconsideration, he has failed to meet the standard for reconsideration. As a new filing for the same relief, he fails to identify the procedural basis for such a repeat filing. In any event, counsel fails to appreciate that the Court's order addresses only whether Petitioner's detention status should be addressed on shortened time (i.e., as a procedural emergency), and he makes no showing that counsel's failure to act timely addresses the central issue of the Court's minute order. Eastern District of California Local Rule 231(b) permits the Court to consider "whether the applicant could have sought relief by motion for preliminary injunction at an earlier date without the necessity for seeking last-minute relief by motion for temporary restraining order." Nothing in the current filing causes the Court to question its prior determination that the issues raised here--no matter their merit--could have been brought earlier by way of a regularly scheduled motion. The evidence of harm cited by counsel is identified by every petitioner who has sought immigration-related habeas relief from this Court--at the rate of nearly 200 per week. Petitioner's request is, in effect, an attempt to jump the line ahead of similarly situated individuals who timely filed their actions. For these reasons, the new request for a temporary restraining order (Doc 16) is DENIED. The motion to amend the petition for writ of habeas corpus (Doc. 15) is referred to the assigned magistrate judge and the hearing unilaterally set by counsel on February 13, 2026, is VACATED signed by District Judge Jennifer L. MINUTE ORDER (Text Entry Only) The Court has read and considered Petitioner's third request for temporary restraining order (Doc. 25). In this TRO, he seeks to obtain his release from custody based upon the recommendation of the magistrate judge, who has concluded that release is the appropriate remedy (Doc. 24). However, because this Court must consider any objections to the findings and recommendations to determine whether it will adopt the recommendations, Petitioner fails to offer any legal basis to justify the Court ignoring this required process. Once again, the Court does not discount the Petitioner's desire for release. As previously noted, however, the evidence of harm cited by counsel is identified by every petitioner who has sought immigration-related habeas relief from this Court--at the rate of nearly 200 per week. Petitioner's third request is yet another an attempt to jump the line ahead of similarly situated individuals who timely filed their actions. The time the Court must take to address these baseless requests is time that could be used addressing the merits of another person's claim. Counsel SHALL NOT file another frivolous motion, or the Court will impose sanctions. The third request for a temporary restraining order (Doc 25) is DENIED signed by District Judge Jennifer L.
