TEXT ORDER - The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Pedro Paulo Rodrigues Teixeira, who is presently detained at the Elizabeth Contract Detention Facility. (ECF No. 1.) According to the Petition, Petitioner is a native and citizen of Brazil who entered the United States without inspection on or about February 20, 2021. Petitioner alleges that, after establishing a credible fear of persecution, his expedited removal order was vacated and he was placed in removal proceedings under INA § 240, where his application for asylum remains pending. Petitioner further alleges that ICE detained him on or about July 11, 2026, after a New Jersey state court ordered his release on pretrial monitoring subject to non-monetary conditions in connection with pending criminal charges, and that he has no criminal convictions or final order of removal. Petitioner contends that his continued detention violates the Due Process Clause of the Fifth Amendment. Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, within seven (7) days of the entry of this Order, why the Petition (ECF No. 1) should not be granted, and shall file with their response all portions of the administrative record necessary for the Court's review. Petitioner may file a reply within three (3) days after service of Respondents' response. Respondents shall not transfer Petitioner outside the District of New Jersey during the pendency of these proceedings. So Ordered by Judge Karen M. Williams on July 15, 2026.
