Judge Myong J. Joun: ELECTRONIC ORDER entered. After reviewing the Petition, Doc. No. 1, and Response, Doc. No. 9, along with Respondents Notice of Transfer of Petitioner, Doc. No. 10, the Court hereby GRANTS the Petition as follows. First, Respondents do not contest that Petitioner is eligible for a bond hearing under 8 U.S.C. § 1226(a), and state that a bond hearing has been scheduled for July 22, 2026. Doc. No. 9 at 1]; [Doc. No. 9-2 at 1]. Given these facts, and the facts set forth in the Petition, Petitioners request for a bond hearing is GRANTED. Second, Respondents have relayed their intent to transfer Petitioner to a processing center in El Paso, Texas. Doc. No. 10 . This request is DENIED. See Tuzolana v. Hyde, 26-cv-10259, Doc. No. 8 (D. Mass. Jan. 23, 2026). While the Court would entertain a request to transfer Petitioner to an appropriate facility for women in neighboring First Circuit states, the lack of such facility is no fault of Petitioners. Texas is not an adequate substitute, especially when the bond hearing set for Petitioner is scheduled in Massachusetts, six days from now. Given these facts, along with Petitioners background and lack of criminal history, Respondents are ORDERED to release Petitioner NO LATER THAN 6PM TODAY, July 16, 2026. Nothing in this Order prevents Respondents from arguing for detention at Petitioners scheduled bond hearing under the Hernandez-Lara standards. (SP) (Entered: 07/16/2026)
