Judge Richard G. Stearns: ELECTRONIC ORDER entered. For the reasons stated in the government's Response (Dkt #9), petitioner Luis Antonio Guaman Castro's prayer for a Writ of Habeas Corpus and release from custody is DENIED. As the government points out, this court by virtue of 8 U.S.C. § 1252(g) has no jurisdiction to review the execution of final orders of removal. Nor has petitioner stated a viable claim of a violation of his due process rights under Zadvydas v. Davis, 533 U.S. 678 (2001), given the relatively brief duration of his current detention. While the intention is to remove Castro to a third country not of his origin (specified as Guatemala, El Salvador, or Columbia), the government warrants that petitioner and his counsel will be afforded the opportunity to express any fear of return before any final removal.The Clerk will close this case.(MKZ) (Entered: 07/03/2025)
