MINUTE ORDER issued by Courtroom Deputy for Chief District Judge Troy L. Nunley on December 18, 2025: The Court has reviewed the parties' briefs on Petitioner's motion for temporary restraining order (ECF No. 12 ). The Court GRANTS Petitioner's motion and a full written order will follow. In the meantime, to avoid further irreparable harm, it is hereby ORDERED that Respondents IMMEDIATELY RELEASE Petitioner from custody under the same conditions as she was released prior to her October 6, 2025 detention. Respondents shall not impose any additional restrictions on her, unless such restrictions are determined to be necessary at a future pre-deprivation/custody hearing. Respondents are further ENJOINED AND RESTRAINED from re-arresting or re-detaining Petitioner absent compliance with constitutional protections, including notice and a hearing before a neutral fact-finder where Respondents show: (a) by clear and convincing evidence, that Petitioner poses a danger to the community or a flight risk, or (b) material changed circumstances which demonstrate a significant likelihood of Petitioner's removal in the reasonably foreseeable future. At any such hearing, Petitioner shall be allowed to have her counsel present. The bond requirement of Federal Rule of Civil Procedure 65(c) is waived.
