MINUTE ORDER IN CHAMBERS of the Honorable Judge Miranda M. Du on 7/31/2026. Respondents filed a first motion to extend time to respond to Petitioner's amended petition for writ of habeas corpus. (ECF No. 7 (Motion).) Petitioner opposes the Motion. (Id. at 1.) Respondents filed the Motion around 3 PM on July 30, 2026 the same date their response was due. (Id.) This practice, as well as the content of the Motion, is nearly identical to another motion to extend by the same counsel which the Court denied on Wednesday, July 29, 2026. See Mendez v. Blanche et al., Case No. 2:26-cv-01854-MMD-BNW (D. Nev. July 29, 2026) (ECF Nos. 10, 12.) The Court reiterates here that the practice of filing for an extension on the same date as the deadline is disfavored and, without more, inhibits finding good cause. As the Court noted in Mendez v. Blanche, Respondents' counsel knew of the cited upcoming appellate brief deadline a week ago but waited until the deadline here to file this Motion. The Court is even less inclined to find good cause here where the Court expressly "further expedite[d] the briefing scheduling considering Petitioner's statement about his medical needs not being met" in detention. (ECF No. 3 at 1.) Therefore, the Court grants in part and denies in part Respondents' Motion. (ECF No. 7 .)
