Judge Myong J. Joun: ELECTRONIC ORDER entered. The Court has reviewed the parties’ Joint Status Report and Proposed Schedule, Doc. No. 20 . Respondents contend that this action is moot because Petitioner has been released from custody. Petitioner responds that claims remain concerning, among other things, the alleged delay in adjudicating her pending DACA application and prospective relief relating to detention or removal while that application remains pending.To the extent the original petition seeks release from Petitioner’s prior detention or a bond hearing, that requested relief is moot. The Court is not persuaded, however, that Petitioner’s release requires dismissal of the entire action at this stage. Whether Petitioner has pleaded an ongoing, redressable injury sufficient to support her remaining constitutional, APA, or other claims is better addressed on a clarified pleading.The Court therefore GRANTS Petitioner leave to file an amended complaint. The amended complaint shall clearly identify each remaining claim, the agency action or inaction challenged, the basis for this Court’s jurisdiction, and the relief requested. Petitioner shall file the amended complaint on or before November 3, 2026. Respondents may thereafter raise mootness, standing, jurisdiction, statutory-channeling, failure-to-state-a-claim, or other defenses by appropriate motion. Respondents’ request to dismiss the action as moot is DENIED without prejudice.(SP) (Entered: 09/08/2026)
