Saavedra; Pla Counsel: Sylvia Irvin and Martin Novillo; Def Counsel: Tamer Botros and Ashlee Hesman; Court Reporter: Samantha McNett; Time of Hearing: 10:50 a.m. - 11:25 a.m.; Courtroom: 6B; The Court made preliminary remarks and heard representations of counsel regarding Petitioners Emergency Motion for Temporary Restraining Order and/or Preliminary injunction ECF No. 8 .Accordingly, as stated on the record the Court GRANTS relief regarding the continued detention without the opportunity to be heard regarding the removal to a third country. The Court therefore orders Petitioners release within the next 24 hours at 10:00 a.m. on January 10, 2026, and shall be released under the prior order of supervision that he was subject to. Further, the Court orders if there was no order of supervision, in the alternative, that the Respondents place Petitioner Humberto Perez case on an immigration court calendar so his release can be appropriately addressed and there can be a hearing scheduled for the removal to a third country.Respondents are to file a status report within two weeks to advise on supervision and when a hearing is scheduled for the supervision aspect of this case.The Court DENIES as moot the request for injunctive or a restraining order.Motion to Seal ECF 9 is GRANTED.
